By registering for, accessing, or using SwaziHost POS, you ("Customer", "you") agree to be bound by these Terms.
Software / Service: The SwaziHost POS application, including web, desktop, mobile components, updates, and related services.
Customer Data: All data entered, uploaded, or processed through the Service by the Customer.
Subscription Plan: The pricing plan selected by the Customer.
User: Any individual authorized by the Customer to use the Service.
2.1 You must be legally capable of entering into a binding contract to use the Service.
2.2 You agree to provide accurate, current, and complete information during registration and to keep your account details up to date.
2.3 You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.
3.1 SwaziHost POS provides features that may include:
Sales processing and invoicing
Inventory and stock management
Customer and supplier management
Reports and analytics
User roles and permissions
3.2 Features may vary depending on the Subscription Plan selected.
3.3 We reserve the right to improve, modify, or discontinue certain features with reasonable notice.
4.1 Use of SwaziHost POS is subject to payment of applicable subscription fees unless otherwise stated.
4.2 Fees are billed in advance (monthly or annually) according to the selected plan.
4.3 All fees are non‑refundable unless required by applicable law or expressly stated in writing.
4.4 Failure to make payment may result in suspension or termination of the Service.
You agree not to:
Use the Service for unlawful, fraudulent, or misleading activities
Attempt to gain unauthorized access to the system or other users’ data
Reverse engineer, copy, or resell the Service without written permission
Upload malicious code, viruses, or harmful content
6.1 The Customer retains full ownership of all Customer Data.
6.2 By using the Service, you grant Swazi Host a limited right to process Customer Data solely for the purpose of providing the Service.
6.3 We implement reasonable technical and organizational measures to protect Customer Data.
6.4 Customer Data may be stored on secure servers and backed up for reliability and recovery.
7.1 While we take reasonable steps to back up data, the Customer is encouraged to maintain independent backups.
7.2 Swazi Host shall not be liable for data loss caused by factors beyond our reasonable control.
8.1 The Service may integrate with third‑party services (e.g., payment gateways, SMS providers).
8.2 We are not responsible for the availability, performance, or policies of third‑party services.
9.1 We aim to provide reliable uptime but do not guarantee uninterrupted availability.
9.2 Planned maintenance may occur with or without notice.
9.3 Technical support is provided according to the selected Subscription Plan.
10.1 We may suspend or terminate access if you:
Breach these Terms
Fail to pay subscription fees
Use the Service in a way that poses security or legal risk
10.2 Upon termination, access to the Service will be disabled and data retention will follow our data retention policy.
11.1 All intellectual property rights in SwaziHost POS remain the exclusive property of Swazi Host.
11.2 These Terms grant you a limited, non‑exclusive, non‑transferable right to use the Service during your subscription period.
12.1 To the maximum extent permitted by law, Swazi Host shall not be liable for:
Indirect, incidental, or consequential damages
Loss of profits, revenue, or business data
12.2 Our total liability shall not exceed the fees paid by you for the Service in the preceding 12 months.
You agree to indemnify and hold Swazi Host harmless from any claims, damages, or losses arising from your misuse of the Service or violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Eswatini.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
